Terms & Conditions
The terms under which I work with you. Plain language, no surprises.
These terms apply to any project commissioned from Kyle Atkins (sole trader, registered in Malta, “I” or “the studio”), and form a binding agreement once you confirm a tier or accept a written quote.
1. Services & tiers
Project scope is defined by the tier you select (One-Pager, Essential, Studio, Tailored) or by a written quote. Each tier includes a fixed deliverables list, delivery window, and number of revisions, as published on the catalogue page at the time of booking.
2. Payment
- All prices are in EUR, inclusive of any applicable taxes I’m required to charge in Malta.
- Standard terms: 50% to start, 50% on launch. Tier 0 (One-Pager) is paid in full upfront due to its short timeline.
- Invoices are payable within 14 days of issue, by SEPA bank transfer or other method we agree in writing.
- Late payment beyond 30 days may incur interest at the rate set by the Late Payments Directive (8% above ECB base rate) plus reasonable recovery costs.
3. Revisions & scope changes
Each tier includes a defined number of revision rounds. A revision round is a single, consolidated batch of feedback. Additional revisions are charged at the per-tier add-on price listed in the catalogue. Scope changes beyond the original brief are quoted separately before work begins.
4. Delivery & timelines
Delivery windows are measured from the moment I have received: (a) the deposit invoice payment, (b) all content you said you’d send, and (c) sign-off on the brief. If any of these are delayed, the delivery window slides by the same amount.
If I miss a deadline through no fault of yours, I will offer a fair remedy (extended support, partial discount, or, for substantial delays beyond two weeks past the agreed window, the option to cancel and refund unbilled work).
5. Intellectual property
- On final payment, you own the website, the source files, and the right to use, modify, and host them indefinitely.
- I retain the right to display the work in my portfolio and to describe it in case studies, unless you ask me in writing not to.
- Third-party assets I integrate (fonts, stock images, plugins) carry their own licences, which I will document and hand over at launch.
- If you do not complete final payment, the IP licence remains with me and the unpaid work may not be used commercially.
6. Cancellation
Either of us can cancel a project in writing at any time. If you cancel after work has started, the deposit is non-refundable; any remaining work-in-progress is billed pro rata. If I cancel, I refund any portion of the deposit not yet earned.
7. Hosting & ongoing maintenance
Unless a Retainer (Care, Growth, or Studio) is in place, project delivery does not include ongoing maintenance, hosting management, or content updates. The site is handed over to your account and your control. You can re-engage me on a retainer or on a per-task basis at any time.
8. Liability
I deliver work in good faith and to a professional standard, but I cannot guarantee specific business outcomes (traffic, conversions, rankings). My maximum liability for any claim relating to a project is limited to the total amount you paid for that project. I am not liable for indirect or consequential losses.
9. Governing law
These terms are governed by the laws of Malta. Any dispute that we cannot resolve in good-faith conversation will be referred to the courts of Malta.
10. Changes to these terms
I may update these terms from time to time. Changes apply to new projects from the date of update. Existing projects continue under the terms in force when they were commissioned.
